Allahabad HC: The Supreme Court has removed two paragraphs from an order issued on August 4, 2025. These paragraphs pertained to barring Justice Prashant Kumar of the Allahabad High Court from hearing criminal cases. The Supreme Court issued this order after Justice Kumar made a comment justifying criminal proceedings in a civil dispute, which drew the Court's displeasure.

Objection of High Court Judges

Regarding this decision, all 13 current judges of the Allahabad High Court have written to the Chief Justice. The letter appeals for the non-implementation of the Supreme Court's order. The judges state that this order affects judicial independence and constitutional balance.

What the Letter States

The High Court judges have demanded that a Full Court meeting be convened on this matter. They argue that the Supreme Court's order not only challenges constitutional values but also directly interferes with the functioning of the High Court. According to the judges, making such a decision regarding the work style of a single judge can affect the independence of the entire institution.

What Was the Original Supreme Court Order?

In its August 4th order, the Supreme Court criticized Justice Prashant Kumar, stating that he wrongly upheld criminal proceedings in a civil matter. The Court also stated that irregularities were observed in the process of granting bail. Based on this, instructions were given to remove him from hearing criminal cases.

Justice Pardiwala's Comment

Justice J.B. Pardiwala, included in the Supreme Court bench, wrote in his order, "The court must first understand the seriousness of the subject, and then deliver a verdict according to the law, keeping in mind the plaintiff's arguments." He further stated that the High Court's order was not only legally incorrect but also a serious oversight of jurisprudence.
