Ajmer Sharif Dargah Case: A new twist has emerged in the ongoing dispute concerning the Dargah of Khwaja Moinuddin Chishti located in Ajmer, Rajasthan. The central government today submitted its recommendation in the case filed by Vishnu Gupta, president of the Hindu Sena, claiming the Dargah as a Shiva temple. This has dealt a major blow to the Hindu side. The central government has recommended dismissing the Hindu Sena's claim, deeming it untenable.

Central Government Files Affidavit

In the lawsuit filed by Vishnu Gupta, president of the Hindu Sena, demanding recognition of the Ajmer Sharif Dargah as a Shiva temple, the central government submitted an affidavit during the hearing. The Ministry of Minority Affairs questioned the maintainability of the lawsuit, stating it lacked a solid basis. The ministry asserted that the Hindu Sena's lawsuit is not tenable and should be dismissed.

The government argued that the lawsuit lacks the necessary circumstances for legal consideration. Furthermore, the Indian Union was not made a party to the lawsuit, and the Hindi translation of the English-filed lawsuit was inadequate. Due to these technical shortcomings, the government recommended its dismissal.

Setback for Hindu Side, Celebrations for Muslim Side

This move by the central government has dealt a significant blow to the Hindu side. Vishnu Gupta, president of the Hindu Sena, has challenged this and stated he will file an appropriate response after seeking legal counsel. Gupta added that if any technical deficiencies exist, they will be rectified, and the case will be resubmitted to the court correctly.

Meanwhile, the Muslim side has welcomed the central government's decision. Ashish Kumar Singh, advocate for the Khadims' organisations, stated that the Muslim side had consistently questioned the maintainability of the lawsuit and appealed for its dismissal from the outset. He further claimed the lawsuit was filed solely for cheap popularity and lacked any legal basis. The Muslim side believes this lawsuit was an attempt to disrupt communal harmony, which is completely wrong.

Technical Flaws in the Lawsuit, Next Hearing on May 31

Following the central government's affidavit, the Ajmer District Court adjourned today's hearing. The next hearing in this matter is scheduled for May 31. The Hindu Sena will now have an opportunity to respond to this recommendation. The court will now observe the Hindu Sena's actions and whether they can successfully rectify the government's cited technical flaws.

This dispute concerning the Ajmer Sharif Dargah has become significant from both religious and legal perspectives. This ongoing controversy has raised questions about the need for communal and religious harmony in Indian society. Accusations and counter-accusations continue between both parties, further escalating the dispute.

Reasons for Dismissal of the Lawsuit

The affidavit filed by the central government also stated that the Hindu Sena's lawsuit lacks any solid grounds to warrant its hearing. Additionally, the government noted that necessary documents and procedures were not followed in this lawsuit. The Hindi translation of the English-filed lawsuit was also inaccurate, leading to the recommendation for dismissal.

The government emphasised that lawsuits filed for cheap popularity and lacking a solid basis should be dismissed. This not only impacts legal proceedings but also attempts to disrupt communal harmony in society.
