Allahabad High Court Clarifies 'Sufficient Opportunity' in Legal Proceedings

Prayagraj, December 26, 2025 - The Allahabad High Court has made a significant observation regarding the meaning of "sufficient opportunity" in judicial proceedings, clarifying that it does not imply granting parties indefinite extensions of time. The court stated that timelines are established under the law to advance the process and must be adhered to.

The Court stated that under the Code of Civil Procedure (CPC), parties may be granted a maximum of three opportunities to complete a specific task, unless a party provides sufficient justification for requiring further time. Furthermore, reissuing an order once it has been passed, or indefinitely suspending the same order, is contrary to the spirit of the justice system. Following this statement from the court, it has become clear that "sufficient opportunity" does not mean prolonging the process or dragging out a dispute indefinitely, but rather providing parties with an equal opportunity to participate in judicial hearings within the timeframes set by the judiciary.

This observation came during the hearing of a writ petition, in which the petitioner had requested more time due to pending proceedings. The High Court dismissed the petition, stating that if a party is dissatisfied with a decision, they may pursue an appeal or other legal remedies as per the applicable procedure. This decision sends a clear signal that adherence to established timelines in court proceedings is mandatory, and that "sufficient opportunity" refers only to time granted within due process, and not an unlimited period.
