CBIC Clarifies New GST Jurisdiction Will Handle All Pending Cases After Business Relocation

The Central Board of Indirect Taxes and Customs (CBIC) has clarified that the new GST jurisdiction will assume responsibility for all pending cases when a registered taxpayer relocates its place of business. Notices already issued, investigations, audits and other legally initiated proceedings will remain valid and continue without interruption, with all subsequent action being carried out on the basis of the earlier proceedings.

CBIC said that a change in the place of business of a registered GST taxpayer will not affect any legal or administrative proceedings initiated before the relocation. If an investigation, audit, Show Cause Notice or any other proceeding is already underway, it will continue in the new jurisdiction without disruption.

According to the Board, the officer in the taxpayer's new jurisdiction will take over all pending matters from the stage reached under the previous jurisdiction. This is intended to ensure that no administrative obstacles arise in the disposal of pending cases.

The CBIC circular states that, following the transfer of the place of business, the new GST jurisdiction will assume responsibility for all pending matters. All valid actions taken by the previous jurisdiction will be fully recognized, and subsequent proceedings will continue on that basis.

The arrangement is intended to ensure that a change in jurisdiction alone does not result in delays or confusion in any investigation, notice or other legal proceeding.

If, after the relocation of the business, any new matter relating to the taxpayer comes to the notice of the officer in the previous jurisdiction, the officer will forward the relevant information to the officer in the new jurisdiction instead of initiating action. Thereafter, all further proceedings will be conducted by the new jurisdiction.

CBIC also clarified that if a taxpayer shifts to another jurisdiction during the pendency of any proceeding, the officer in the new jurisdiction will continue the matter from the same stage and carry it through to its final disposal. This will ensure continuity in GST administration and prevent procedural uncertainty for taxpayers.
