New Delhi: Home Minister Amit Shah recently bly supported the constitutional amendment bill in Parliament related to the removal from office of an arrested Prime Minister or Chief Minister if they receive bail within 30 days. He stated that this bill is not just a law but also a means of upholding ethical values. Sharing his personal experience, Shah mentioned that when a case was ongoing against him in Gujarat, he received bail on the 96th day, but he did not take an oath nor did he work in any constitutional position.
Maintaining Both Law and Ethics is Essential
Amit Shah said that whether it is the Prime Minister, Chief Minister, or any other minister, they cannot run the government while in jail. He mentioned that earlier as well, many senior leaders had resigned on moral grounds. These include names like Lal Krishna Advani and George Fernandes. Recently, the Chief Minister of Jharkhand, Hemant Soren, also resigned while adhering to ethics. Shah said that now a legal provision has been made on this so that the ethical responsibility of any leader can be ensured in the future.
Shah emphasized that the framers of the Constitution would not have imagined a situation in which a Chief Minister continues to hold office while in jail. This bill will provide a basis for maintaining the level of ethical values and will send a message of ethics to society.
Shared His Experience in Gujarat
Amit Shah recalled the time when he was the Home Minister of Gujarat and a case was ongoing against him. He stated that he received a summons and was arrested. In this situation, he immediately resigned. He said that later the judgment came and it was proven that the case was made under political vendetta and he was found completely innocent.
Shah said that his bail was granted on the 96th day, but despite this, he did not take the oath of a constitutional office, and he did not start working in any position until the charges were completely dropped. He taunted the opposition, saying that he does not need to be taught a lesson in ethics.
Experiences During Arrest and Bail
Amit Shah mentioned in the interview that Justice Aftab Alam had set up a special court on Sunday to hear his bail application. Shah said that his lawyer suggested that he should stay outside Gujarat until the decision on the bail application came. Accordingly, Shah handled his case while staying outside Gujarat for two years. He said that in the history of India, no one's bail application had ever lasted for two years, and it was Alam Sahib's grace that his bail lasted so long.
Shah stated that generally, a bail application is disposed of in 11 days, but the circumstances were special in his case. Referring to his experience, he said that he had full faith in the judiciary and he followed all the legal procedures before taking the oath of any constitutional office.
