The Delhi government has initiated steps to file a review petition in the Supreme Court regarding the strict rules applicable to old diesel and petrol vehicles. The government believes that changes are necessary considering the practical aspects and current circumstances of these rules. To this end, the Transport and Environment Departments have been directed to thoroughly analyze the existing guidelines, legal provisions, and their practicality. Furthermore, public opinion and the environmental impact of these rules are also being taken into account.
Environment Minister Manjinder Singh Sirsa stated that the government will review the reports prepared by all relevant departments. Subsequently, a final decision will be made on filing the review petition in the Supreme Court. The minister also clarified that the government will present its case before the court with fact-based and solid arguments.
Supreme Court Order Becomes a Major Obstacle
It is noteworthy that the Supreme Court, in 2018, ordered the cessation of operation of diesel vehicles older than 10 years and petrol vehicles older than 15 years in Delhi. Prior to this, the National Green Tribunal (NGT) in 2014 also prohibited parking vehicles older than 15 years in public places. These orders were issued to control pollution in Delhi, but now these very guidelines are being described as practically challenging.
Chief Minister Rekha Gupta recently stated that the same rules should apply in Delhi as are effective in other parts of the country. This comment came after a letter from Lieutenant Governor V.K. Saxena, in which he stated that strictness only in Delhi on old vehicles is against the principles of justice.
Request Sent to the Commission for Air Quality Management as Well
In addition, the Delhi government has also requested the Commission for Air Quality Management (CAQM) to temporarily suspend the fuel restrictions imposed on old vehicles. Minister Sirsa, in a letter to the Chairman of the Commission, stated that this restriction is impractical and there are several technical challenges in its implementation that cannot be ignored.
This initiative by the Delhi government has raised hopes of potential relief for old vehicle owners.
