Court's Verdict: Insurance Company to Pay Compensation, Right to Recover from Driver Retained

This verdict was delivered by the court of District Judge (MACT) Vikram on October 27, 2025. The court ordered Bajaj Allianz General Insurance Company to pay this amount to the deceased's family within 30 days. Additionally, the court clarified that since the accused driver, Amit Khanna, did not possess a valid driving license at the time of the accident, the insurance company can recover this amount from Amit Khanna and the vehicle owner, Lokesh Prasad Sharma, after making the payment.

The court stated in its order that “the identification of the vehicle and the circumstances of the accident are clearly proven by CCTV footage. The driver's negligence was the primary cause of this accident. The court also directed that an annual interest rate of 7.5% would be applicable on the compensation amount, calculated from April 3, 2023 — meaning the family will also receive interest from the date of the accident until the date of payment.

The Night of the Accident: That Tragic Incident of December 31, 2022

The accident occurred on the Sultanpuri-Kanjhawala Road in Delhi on the night of December 31, 2022. The deceased, Anjali Singh, who worked at an event management firm, was returning home on her scooter. Suddenly, a grey Baleno car (DL8CAQxxxx) coming from behind on Shani Bazar Road violently collided with her scooter.

Anjali's friend Nidhi, who was with her at the time, fell off the scooter and survived. However, Anjali got trapped under the car and was dragged for several kilometers. Later, her body was found in a naked state on the Kanjhawala-Qutubgarh Road by the police. A black shoe, a scarf, earphones, and broken parts of the scooter were recovered from the scene.

Delhi Police investigation proved that Amit Khanna was driving the car at the time of the accident. This fact was corroborated by forensic reports and CCTV footage. Based on this, the police filed a chargesheet under IPC Sections 279 (rash driving) and 304A (causing death by negligence).

The deceased's mother, Rekha Devi, along with her two daughters and younger son, had filed a compensation petition in court. Although the court acknowledged that concrete documents related to the deceased's income were not available, the judge determined the compensation considering the estimated income and the family's financial dependence.
