New Delhi: Asaduddin Owaisi, the chief of All India Majlis-e-Ittehadul Muslimeen (AIMIM) and Member of Parliament from Hyderabad, has raised serious questions about the bills recently introduced in Parliament. These bills include provisions for the removal of the Prime Minister, Chief Ministers, and ministers. Owaisi stated that this bill is unconstitutional and could be misused.

Can the President remove the Prime Minister?

Owaisi questioned whether the President can actually demand the resignation of the Prime Minister. He said that according to the Constitution, the President makes decisions only on the advice of the Council of Ministers. However, the proposed bill states that the President has the power to remove the Prime Minister. Owaisi described this as being against the basic principles of democracy and the Constitution.

Objective and Provisions of the Bill

This bill has been sent to the Joint Parliamentary Committee (JPC). The bill mentions that if the Prime Minister or Chief Minister is caught in a serious crime and remains in custody for 30 consecutive days, they will be removed from office. Owaisi questioned whether this provision could open the way for abuse of power.

Owaisi's Allegation

Owaisi warned that the central government could misuse this provision. He said that if the Centre wishes, it could arrest four or five ministers of a state government, and the government would automatically fall. This would endanger the freedom of democracy and deprive the people's elected representatives of their rights.

Allegation of Creating a Police State

Owaisi also said that the government is trying to create a 'police state' through this bill. He stated that this bill would take away the rights of the people's elected representatives and weaken the foundation of democracy. He emphasized that this step would be like an attack on the elected government.

Impact on Legislature, Executive, and Judiciary

Owaisi argues that this law will weaken the independence of all three pillars of power—the legislature, the executive, and the judiciary. If the Centre misuses this provision, control over state governments will increase, and the importance of the people's vote will decrease. He said that the people's decision should be paramount in a democracy.

Owaisi Protested in Parliament

When this bill was presented in Parliament last week, Owaisi bly opposed it. He said that this law is against the principles of democracy, and implementing it could create political instability in society. He warned the central government not to violate democratic values and the rights of the people.

Apprehension of Potential Misuse

Owaisi expressed apprehension about the potential misuse of this bill. He said that the central government could use it for its political interests. This would jeopardize the stability of state governments and weaken democracy. The purpose of the law should be to protect the public and improve governance, not to exert political control.
