Delhi High Court Questions Maintainability of Sameer Wankhede's Defamation Suit Against SRK's Production and Netflix

The Delhi High Court has raised questions regarding IRS officer Sameer Wankhede's defamation petition. Wankhede has alleged that his reputation was damaged in Shah Rukh Khan's web series 'The Baads of Bollywood'.

Delhi News: The Delhi High Court has raised questions regarding the defamation petition filed by IRS officer Sameer Wankhede. Wankhede has filed a defamation suit against Red Chillies Entertainment, owned by Bollywood actor Shah Rukh Khan and his wife Gauri Khan, and Netflix. The petition alleges that his honor and reputation were harmed in the web series 'The Baads of Bollywood' produced by these entities.

Court Questions Maintainability in Delhi

Justice Purushaindra Kumar Kaurav questioned Wankhede's counsel on how this petition is maintainable in Delhi. The Court clarified that before filing the petition, it is essential to determine whether the case can be heard in a Delhi court. The logic behind this query is that in a defamation claim, the location of the alleged incident and the affected area are crucial.

Wankhede's Allegations

In his petition, Sameer Wankhede stated that his personality and work style have been inaccurately portrayed in the web series 'The Baads of Bollywood'. He alleges that the manner in which his image is presented in the series could foster a negative perception among the public. Wankhede claims that this attempt to damage his professional honor falls under defamation and necessitates legal action.

Counsel's Argument

Senior advocate Sandeep Sethi, representing Wankhede, informed the Court that the web series is available across India, including Delhi, and as a result, the impact on the officer's image can also be observed in Delhi. He argued that on this ground, the petition could be maintainable in Delhi. Furthermore, he sought the Court's permission to make necessary amendments to the petition to ensure a proper hearing of the case.
