Bihar Voter List: Controversy is deepening over the special intensive revision (SIR) of the voter list in Bihar before the upcoming assembly elections. Meanwhile, Trinamool Congress (TMC) MP Mahua Moitra has challenged the Election Commission's order in the Supreme Court. She has demanded the quashing of the notification issued on June 24, 2025, which initiated the special revision of the voter list in Bihar.
MP Mahua Moitra Files Petition
Mahua Moitra, filing a public interest litigation under Article 32 of the Constitution in the Supreme Court, stated that the Election Commission's move is unconstitutional. She argues that the order not only violates the fundamental rights of citizens but also disregards constitutional and legal provisions related to voter registration.
Constitutional Questions Raised in the Petition
The petition claims that the Election Commission's notification violates Articles 14 (right to equality), 19(1)(a) (freedom of expression), 21 (protection of life and personal liberty), 325, and 326 (electoral rights) of the Constitution. Furthermore, it alleges a violation of the rules of the Representation of the People Act, 1950, and the Electoral Registration Rules, 1960.
Objection to Exclusion of Aadhaar Card from the List of Identity Proofs
The main objection from the opposition is that the Aadhaar card has not been included in the list of identity proofs. Mahua Moitra and several opposition parties are questioning why the Aadhaar card, which the government has declared as a primary means of identification, is not being recognized in the voter identification process.
Unusual Demand to Prove Citizenship for the First Time
The petition also objects to the demand for many people, who have voted several times before, to now prove their citizenship. The petition calls this unconstitutional and arbitrary.
Allegation of Violation of Rules
Mahua Moitra says that the process of adding or removing names from the voter list should only be done under the rules and prescribed Form 7 of the "Representation of the People Act." She has alleged that the current process being adopted in Bihar violates these rules.
The same process may be implemented in other states as well
There are reports that a similar process is being implemented in other states along with Bihar. The Election Commission may start such a revision process in West Bengal, where assembly elections are to be held next year. The opposition has also expressed concern about this.

Mahua Moitra, in a post on the social media platform X (formerly Twitter), said that she has challenged the special revision of the voter list in Bihar in the Supreme Court. Along with this, she has demanded that the process be stopped in other states until the Supreme Court gives its decision on the matter.
