The Supreme Court has acknowledged Judge Dinesh Gupta as a talented officer while hearing his petition regarding frequent transfers. The Court directed the Acting Chief Justice of the High Court to consider his representation sympathetically within two weeks, taking into account his health, impending retirement, and family circumstances.
Jaipur: District and Sessions Judge Dinesh Gupta approached the Supreme Court, distressed by repeated transfers. With only 10 months remaining until his retirement, he has been transferred multiple times in recent months, causing significant personal, familial, and health-related difficulties.
Judge Gupta stated in his petition that he is battling a serious illness and undergoing regular treatment in Jaipur. Additionally, his wife is a teacher nearing her retirement. These frequent transfers have placed the entire family under considerable mental stress.
Supreme Court Observation
The case was heard by a Supreme Court bench comprising Chief Justice of India Justice Suryakant, Justice Joymala Bagchi, and Justice Vipul M. Pancholi. During the hearing, the Supreme Court explicitly stated that Dinesh Gupta is a talented and capable judge.
The Court noted that his assignments as Director (Law) in the Jaipur Development Authority (JDA) and a role in the Legal Services Authority should not be viewed as punitive measures. The Court acknowledged that these appointments were a result of his competence and capabilities.
However, the Court also conceded that his health condition, limited time until retirement, and family circumstances could not be disregarded.
Instructions to the Acting Chief Justice of the High Court
The Supreme Court instructed the Acting Chief Justice of the Rajasthan High Court to consider Judge Dinesh Gupta’s representation with sympathy within two weeks. The Court clarified that this decision should be taken with administrative discretion, but with due consideration for the human aspects involved.
This directive has raised hopes for Judge Gupta, as his transfers will now be reconsidered at a higher level.
First Transfer Followed a Landmark Decision

Judge Dinesh Gupta was posted at the Commercial Court in Jaipur. On July 5, 2025, he imposed a fine of 50 lakh rupees on a private company. On the same day, he was transferred from Jaipur to Beawar as the Principal District and Sessions Judge.
Subsequently, within just five months, on December 2, 2025, he was transferred again, this time from Beawar to Jalor. These continuous transfers caused Judge Gupta significant mental and physical distress.
He submitted a representation to the Acting Chief Justice of the Rajasthan High Court requesting to remain posted in Jaipur, but when no action was taken, he approached the Supreme Court.
Remained in the Headlines Due to Prominent Judgments
Throughout his judicial career, Judge Dinesh Gupta has been known for several significant and high-profile judgments. In 2005, while serving as a Magistrate in Jaipur, he issued arrest warrants against the then Jaipur SP and two RAS officers for disrespecting the national flag during a rally.
Furthermore, he issued an arrest warrant in a case against Lalit Modi, the then President of the RCA and IPL Commissioner. During his tenure at the Sawi Madhopur POCSO Court, he also required the then DGP, Kapil Garg, to appear in his court in connection with a case.
Major Disclosure While at JDA
While working as the Legal Director at the Jaipur Development Authority, Judge Gupta exposed a case of alleged collusion to illegally seize billions of rupees worth of government land in Jaipur. His strictness helped save a substantial portion of the land from illegal occupation.
His decisions and working style have consistently kept him in the spotlight. The Supreme Court’s observation confirms that he has a reputation within the judiciary as an honest and fearless officer.
