Prayagraj. The Allahabad High Court has upheld a lower court's maintenance order, rejecting a husband's petition. The court stated that he has the obligation to maintain his wife and daughter.

What was the case?

The case originated from Kanpur, where the petitioner, Gaurav Gupta, challenged the Family Court's order in the High Court.

The Family Court had directed Gaurav to pay a total of ₹40,000 per month as maintenance to his wife, Ritika Gupta, and their daughter (₹20,000 for the wife + ₹20,000 for the daughter).

Gaurav argued that this amount was excessive, as his annual income was only ₹2,40,000 (which is approximately ₹20,000 per month). He also stated that he is a director in the company, but the company has incurred losses.

The wife responded that neither she nor her daughter could be self-reliant and required regular support.

High Court's Order

The High Court upheld the lower court's order and dismissed the petition. The Court stated that the husband had attempted to conceal his actual income.

The court assumed that Gaurav has the capacity to pay maintenance to his wife and daughter. It was also stated that even if a woman is educated, it cannot be claimed that she loses her entitlement to maintenance. Dismissing the petition, the High Court ordered the husband to continue paying maintenance.
