Allahabad High Court Dismisses Rahul Gandhi's Plea in Savarkar Remark Case, Says Revision Petition Option Available in Sessions Court.

Rahul Gandhi News: The Lucknow Bench of the Allahabad High Court dismissed the petition filed by Leader of the Opposition in Lok Sabha, Rahul Gandhi, concerning the alleged derogatory remarks made against Vinayak Damodar Savarkar. The court stated that the petitioner has the option of filing a revision petition in the sessions court and therefore, the High Court's intervention is not necessary at this stage.

Challenge to Lower Court Order

Rahul Gandhi challenged the lower court's order summoning him under sections 153A and 505 of the IPC. The petition argued that there were procedural errors in the court's proceedings and that the charges under the relevant sections were not made out.

Advocate's Argument

Rahul Gandhi's counsel, Pranshu Agrawal, argued before the court that the charges contained neither communal incitement nor any element that could promote social animosity. Despite this, the lower court summoned him.

Court Refrains from Commenting on Merits

The single bench of Justice Subhash Vidyarthi clarified that commenting on the merits of the case would be inappropriate at this juncture. The court simply stated that the petitioner should utilize the alternative remedy available under the law.
