The court has made it clear that passing the Teacher Eligibility Test (TET) will now be mandatory for all new teachers and those seeking promotion.
TET Will Be Necessary for New Jobs and Promotions
A Supreme Court bench, comprising Justices Dipankar Datta and Manmohan, stated in its order that any teacher applying for a new job or seeking a promotion must first pass the TET. Any claim without passing the TET will not be considered valid.
Relief for Teachers with Less Than 5 Years of Service
However, the court has provided relief to those teachers who have less than 5 years remaining in their service. Such teachers can continue in their jobs until retirement without passing the TET. But if they desire a promotion, they will also be required to pass the TET.
2-Year Grace Period for Senior Teachers
The court also stated that teachers appointed before the implementation of the Right to Education (RTE) Act, 2009, and who have more than 5 years of service remaining, must pass the TET within two years. Failure to do so will impact their jobs, and they will only be eligible for terminal benefits.
Temporary Relief for Minority Institutions
The Supreme Court clarified in its order that this rule will not currently apply to educational institutions with minority status. In fact, the matter of whether the RTE Act is applicable to minority schools is currently pending before a larger bench of the Supreme Court. Until a final decision is reached on this, the TET requirement will not be mandatory for these institutions.
