Allahabad High Court: Complainant's Statement Not Sole Basis If Accused Is Also Injured

Prayagraj — The Allahabad High Court has clarified in a criminal case that if the accused party is also injured in the incident, the statement of the complainant (plaintiff) alone cannot be considered a decisive basis.

A division bench of Justice Rajiv Misra and Justice Dr. Ajay Kumar made this observation, stating that a comprehensive evaluation of evidence is necessary — relying solely on one party's statement is not just.

This decision came in a similar case registered in the Tajganj police station area of Agra, where the trial court had acquitted the accused of charges including attempt to murder, death threats, and knife attack.

The court also stated that the complainant's statement of being injured should only be considered decisive if it corroborates with medical reports and other evidence.
