National Herald Case: Delhi Court Defers Decision on ED Charge Sheet Against Sonia, Rahul Gandhi

Delhi's Rouse Avenue Court has deferred its decision on the ED's charge sheet in the National Herald case, involving Sonia and Rahul Gandhi, until December 16, 2025, for re-examination of case files.

The court's decision on the charge sheet in the National Herald case, linked to Sonia Gandhi and Rahul Gandhi, was expected today (Saturday) but has been postponed. Delhi's Rouse Avenue Court had deferred the pronouncement of its order on the ED's charge sheet in the previous hearing.

New Delhi: In the National Herald case, the Delhi court's decision on the Enforcement Directorate (ED)'s charge sheet, concerning Congress leaders Sonia Gandhi and Rahul Gandhi, has been deferred. The decision was expected on Saturday, but the court has now postponed it until December 16, 2025. Rouse Avenue Court stated in the previous hearing that the reason for deferring the order on the charge sheet was the necessity of re-examining the case files.

In this case, former Congress President Sonia Gandhi, MP Rahul Gandhi, late leaders Motilal Vora and Oscar Fernandes, along with Suman Dubey, Sam Pitroda, and the company Young Indian, have been named as accused. This case has been ongoing through legal procedures for a long time, and the court's next decision will prove to be a significant milestone in this entire dispute.

Allegations Against Sonia Gandhi and Rahul Gandhi

The ED alleges that Sonia Gandhi, Rahul Gandhi, and other leaders, as part of a conspiracy, illegally took possession of assets worth approximately 2,000 crore rupees belonging to Associated Journals Limited (AJL). The case originated from a complaint filed by former MP Subramanian Swamy. The complaint accuses Congress leaders and companies associated with AJL of misusing funds.

The ED's charge sheet alleges that the Gandhi family held 76 percent shares in Young Indian company. This company allegedly fraudulently acquired AJL's assets in exchange for a loan of 90 crore rupees. The charge sheet includes the names of Sonia Gandhi, Rahul Gandhi, Suman Dubey, Sunil Bhandari, Sam Pitroda, Young Indian, and 'Dotex Merchandise Private Limited'.

Background of the National Herald Case

The National Herald newspaper is published by Associated Journals Limited. An investigation initiated in 2012 by the Enforcement Directorate found that the Gandhi family and their close associates allegedly misused the company's funds. The objective of this investigation is to determine whether the assets of AJL and its associated companies were used for political and personal gain.

The complaint filed by Subramanian Swamy alleged that the Gandhi family, through Young Indian, illegally took possession of AJL's assets and used them for personal gain. This case has sparked a long debate in Indian politics and media.

Court Proceedings and Upcoming Hearing

Rouse Avenue Court had stated in the previous hearing that a re-examination of files and evidence was necessary before deciding on the charge sheet. The court clarified that the final decision on the charge sheet in this case would be pronounced only on December 16. The court's decision is considered very significant in this case, given its electoral and political background.

If the court takes cognizance of the charge sheet, the case will proceed towards serious legal action against the accused. Conversely, if the court dismisses the charge sheet, the direction of the investigation and the legal status of the case may change.
