A significant decision has emerged in Indian politics and judicial matters. The Supreme Court has provided relief to Abhay Singh Chautala by dismissing the petition filed against him. This petition was filed by retired IPS officer Paramveer Rathi.
New Delhi: The Supreme Court on Tuesday dismissed a petition filed by a retired IPS officer challenging an order of the Punjab and Haryana High Court. The petition sought to set aside the High Court's decision to quash the order summoning Indian National Lok Dal chief Abhay Singh Chautala in a defamation case filed in 2008. This case was registered by the retired IPS officer.
A bench comprising Justice MM Sundresh and Justice Satish Chandra Sharma clarified that the Supreme Court was not inclined to interfere with the High Court's order. The hearing took place on the petition filed by Paramveer Rathi, challenging the High Court's December 19, 2023 order which had quashed the summoning order against Chautala.
What was the case
The petition challenged the order of the Punjab and Haryana High Court that decided to quash the order summoning Chautala in a defamation case filed in 2008. The petition alleged that Chautala made defamatory statements against the retired IPS officer, which were published in various newspapers and damaged the officer's reputation.
Supreme Court's Decision
The Supreme Court bench included Justice MM Sundresh and Justice Satish Chandra Sharma. The court clearly stated that it was not inclined to interfere with the High Court's order. Consequently, the Supreme Court dismissed Paramveer Rathi's petition.
- August 2008: A retired IPS officer filed a complaint against Chautala and some others. The complaint alleged that Chautala made defamatory statements against the officer, causing irreparable damage to his reputation.
- 2010: A court in Gurugram issued a summons to Chautala. Chautala challenged this summons in the Additional District and Sessions Court.
The High Court quashed the summoning order. The High Court stated that it was not established during the preliminary evidence presented by Rathi that Chautala had made the alleged defamatory statements. This High Court decision was challenged in the Supreme Court, but the Supreme Court dismissed it.
