The Delhi High Court dismissed a petition seeking the removal of the graves of Afzal and Maqbool Bhat from the Tihar Jail premises. The court delivered its decision considering the respect for last rites and security concerns.
New Delhi: The Delhi High Court unequivocally refused to entertain a petition seeking the removal of the graves of terrorists Mohammad Afzal and Mohammad Maqbool Bhat from the Tihar Jail premises. The petitioner had claimed that these graves were glorifying terrorism and causing misuse of the jail compound.
A bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela stated that these graves were established within the jail premises in 2013, and challenging them 12 years later is not appropriate. The court also observed that respect for an individual's last rites should be maintained, and the government had addressed this issue keeping sensitive circumstances in mind.
Purpose of the Plea
The petition, filed by the Vishwa Vaidik Sanatan Sangh, suggested that the graves of Afzal and Maqbool Bhat should be relocated to a secure and secret place elsewhere. Their argument was that the construction and continued existence of these graves within the jail premises are illegal and unconstitutional. The petitioner also asserted that these graves glorify terrorism and violate the peace and security regulations of the jail premises.
